PREAMBLE
The CAP CHARENTE digital platform is a public tool designed to enhance the visibility and accessibility of economic land opportunities within the Charente department.
Managed by the Union Patronale de la Charente (UPC) through its Territorial Commission, its purpose is to centralize, structure, and disseminate information relating to land and real estate assets intended for economic activities that are available or may become available within the Charente region, for the benefit of investors, project developers, local authorities, and their partners.
The Platform is also intended to facilitate connections between Users—whether Contributors, investors, or project developers—and the relevant local institutional and operational stakeholders responsible for supporting the implementation of economic development projects in Charente (State services, local authorities, utility providers, emergency services, development agencies, business networks, etc.).
These Terms and Conditions of Use (hereinafter the “TCU”) govern all conditions of access to and use of the Platform, both for Visitors and registered Contributors. They constitute a contractual agreement between each User and the UPC.
Accessing the Platform in any form implies full, complete, and unconditional acceptance of these TCU.
ARTICLE 1 – PURPOSE AND PLATFORM PUBLISHER
1.1 Purpose
These TCU define:
the conditions for accessing the CAP CHARENTE Platform, either as a Visitor or a registered Contributor;
the rights and obligations of each category of User;
the rules governing the publication, management, and moderation of economic land listings;
the procedures relating to the processing of personal data;
the liability regime applicable to the UPC and Contributors;
the conditions under which the Platform directs Users to relevant local institutional and operational contacts capable of supporting economic establishment projects.
1.2 Publisher
The CAP CHARENTE Platform is published by the Union Patronale de la Charente, a registered association governed by the French Law of July 1, 1901 (SIRET: 781 172 002 00029), whose registered office is located at 33 rue de l'Arsenal, 16000 Angoulême, France. The UPC is responsible for coordinating, managing, moderating, and administering the Platform. It acts as the data controller within the meaning of the General Data Protection Regulation (GDPR).
ARTICLE 2 – DEFINITIONS
For the purposes of these TCU:
“Listing” means the structured set of data and documents describing a plot of land or a property intended for economic activity, entered by a Contributor according to the Platform's data model.
“Back Office” means the secure administration interface accessible to Contributors and UPC administrators for managing Listings, accounts, and content.
“Draft” means any Listing saved by a Contributor but not yet submitted to the UPC for publication review.
“Contributor” means any natural or legal person holding an account approved by the UPC and authorized to create, publish, and manage economic land Listings on the Platform. Contributors may include landowners, public intermunicipal cooperation bodies (EPCI), partner local authorities, and duly authorized representatives (notaries, commercial real estate consultants, mandated agencies, etc.).
“Moderation” means all actions involving the review, approval, correction, suspension, or removal of a Listing by the UPC.
“Platform” means the CAP CHARENTE website accessible at www.cap-charente.fr, including its public interfaces, contributor area, and administrative Back Office.
“Publication” means the online publication of a Listing on the public or partially public sections of the Platform following approval by the UPC.
“Revalidation” means the process by which a Contributor confirms, after a period of sixty (60) calendar days, the accuracy and currency of the information contained in a published Listing.
“User” means any natural or legal person accessing the CAP CHARENTE Platform in any capacity, whether as a Visitor or Contributor.
“Visitor” means any person accessing the public section of the Platform without creating an account and solely for consultation purposes.
ARTICLE 3 – ACCESS TO THE PLATFORM
3.1 Visitor Access
Access to the public section of the Platform is free of charge and does not require account creation. Visitors may browse published Listings, use the interactive map, apply search filters, and download available documents.
Certain Listing fields are restricted and not publicly accessible. Publicly visible fields are those expressly designated as such in the Platform’s data model.
3.2 Contributor Access
Creating and publishing Listings, as well as accessing account-specific restricted information, requires the creation of a Contributor account that has been approved by the UPC.
Contributor access provides the right to use the Back Office to create, manage, and update Listings within the limits established by these TCU.
3.3 Access Levels
The Platform distinguishes at least three levels of access:
Visitor: consultation of Listings and publicly visible content;
Contributor: creation, modification, submission, and updating of Listings relating to properties owned or managed under authorization or mandate;
3.4 Technical Conditions of Access
The Platform is accessible through up-to-date web browsers on computers, tablets, and mobile devices. Users are responsible for having suitable hardware, sufficient internet access, and a compatible browser. The UPC does not guarantee compatibility with outdated browsers, unsupported operating systems, or inadequate hardware configurations.
Access is subject to internet and hosting service availability. The UPC reserves the right to interrupt, suspend, or restrict access temporarily without notice or compensation for maintenance, updates, technical developments, or force majeure events. The UPC shall not be liable for service interruptions, data loss, or any damage resulting from temporary unavailability or inadequate user equipment.
3.5 Connection with Local Stakeholders
In addition to its role of cataloguing and promoting economic land opportunities, the UPC reserves the right to contact any User in order to facilitate introductions to institutional and operational stakeholders capable of supporting the implementation of economic development projects in Charente.
Such stakeholders may include, among others:
relevant State authorities (DREAL, Prefecture of Charente, etc.);
local authorities and public bodies (Nouvelle-Aquitaine Region, Charente Department, EPCIs);
emergency and safety services (SDIS);
economic development agencies and organizations;
utility and infrastructure operators (water, energy, telecommunications, transport).
Such introductions are optional and purely indicative. The UPC has no obligation to propose contacts and does not guarantee their availability, expertise, responsiveness, or the outcome of any exchanges.
ARTICLE 4 – CONTRIBUTOR REGISTRATION AND ACCOUNT APPROVAL
4.1 Registration Request
Anyone wishing to obtain Contributor status must submit an application through the registration form available on the Platform.
4.2 Approval by the UPC
No Contributor account is activated automatically. The UPC reviews each request and may approve it, request supporting documents, or reject it without being required to justify its decision.
The Contributor remains solely responsible for the accuracy, completeness, and truthfulness of the information provided during registration and throughout use of the Platform.
4.3 Training and Onboarding
Before publication, Contributors are invited to review any documentation or instructions provided by the UPC regarding the submission and management of Listings.
4.4 Account Status and Credentials
Contributor accounts are personal and non-transferable. Contributors are solely responsible for maintaining the confidentiality of their login credentials and must immediately notify the UPC of any unauthorized access.
ARTICLE 5 – CONTRIBUTOR OBLIGATIONS
5.1 Eligibility
Only landowners, partner public authorities, EPCIs, and duly authorized representatives holding valid written mandates may publish Listings.
5.2 Accuracy of Information
Contributors guarantee that all information contained in their Listings is accurate, truthful, current, and reflects the actual status of the property at the time of entry.
5.3 Rights to Publish
Contributors guarantee that they possess all rights and authorizations necessary to publish the information, documents, photographs, and plans included in their Listings and shall indemnify the UPC against any third-party claims.
5.4 Ongoing Updates
Contributors undertake to keep Listings continuously updated and accurate. Any change affecting a property must be reflected in the corresponding Listing without delay.
5.5 Mandatory Periodic Revalidation
Every published Listing must be revalidated every sixty (60) calendar days. If the Contributor fails to revalidate within fifteen (15) calendar days after notification, the Listing will be automatically suspended and removed from public view until revalidated.
5.6 Mandatory and Recommended Fields
Contributors must complete all fields designated as mandatory in the Platform’s data model before a Listing can be submitted for moderation.
ARTICLE 6 – LISTING PUBLICATION PROCESS
6.1 Draft Creation
Contributors may create and save Listings as Drafts before submission.
6.2 Submission for Moderation
Once complete, Listings may be submitted to the UPC for review.
6.3 Review by the UPC
The UPC may approve, request amendments, or reject Listings that do not meet the Platform’s quality or compliance requirements.
6.4 Publication
A Listing becomes publicly visible only after formal approval by the UPC.
6.5 Post-Publication Modifications
Significant modifications to a published Listing require renewed validation by the UPC before publication.
ARTICLE 7 – EXPIRATION AND SUSPENSION OF LISTINGS
Listings automatically expire after sixty (60) calendar days if not revalidated. The UPC may suspend or remove Listings at any time if they contain inaccurate, misleading, unlawful, outdated, or non-compliant information.
ARTICLE 8 – INTELLECTUAL PROPERTY
The Platform, its structure, design, databases, editorial content, maps, logos, and technical developments are protected by French and European intellectual property laws. Any reproduction or reuse without prior written authorization from the UPC is prohibited.
Contributors retain ownership of the content they upload but grant the UPC a non-exclusive, royalty-free license to display such content for the duration of its publication on the Platform.
ARTICLE 9 – PERSONAL DATA
The UPC processes personal data in accordance with the GDPR and applicable French data protection laws. Full details regarding processing activities, retention periods, cookies, user rights, and security measures are available in the Platform’s Privacy Policy.
ARTICLE 10 – LIMITATION OF LIABILITY
The information published on the Platform is provided for informational purposes only and does not constitute a binding offer, promise of sale or lease, solicitation, or professional advice.
The UPC acts solely as a facilitator and publisher of information provided by Contributors and cannot be held liable for inaccuracies, omissions, outdated information, decisions made based on Platform content, temporary service interruptions, or any indirect damages.
The Platform is provided on an “as is” basis without any guarantee of uninterrupted operation or error-free performance.
ARTICLE 11 – ACCEPTABLE USE AND PROHIBITED CONDUCT
Users must use the Platform lawfully and in accordance with its intended purpose.
Prohibited activities include, but are not limited to:
submitting false, misleading, or fraudulent information;
using the Platform for unauthorized advertising or commercial solicitation;
attempting to bypass security or authentication mechanisms;
unauthorized automated data extraction (scraping);
publishing unlawful or offensive content;
conduct likely to damage the Platform, the UPC, or its partners.
Violations may result in account suspension, removal of Listings, and legal action.
ARTICLE 12 – EXTERNAL HYPERLINKS
The Platform may contain links to third-party websites. The UPC assumes no responsibility for their content, accuracy, or operation.
ARTICLE 13 – PLATFORM AND TCU CHANGES
The UPC reserves the right to modify the Platform and these TCU at any time to reflect legal, technical, or operational developments. Registered Contributors will be informed of substantial amendments by electronic means.
ARTICLE 14 – APPLICABLE LAW AND DISPUTE RESOLUTION
These TCU are governed by French law.
Any dispute shall first be subject to an amicable resolution process. If no agreement is reached, jurisdiction shall lie with the competent French courts having authority over the UPC’s registered office, unless mandatory legal provisions provide otherwise.
ARTICLE 15 – FORCE MAJEURE
Force majeure shall have the meaning provided by Article 1218 of the French Civil Code and includes, without limitation, natural disasters, widespread internet outages, hosting provider failures, cyberattacks, and legal or regulatory restrictions imposed by public authorities. The UPC shall not be liable for any Platform unavailability resulting from such events.
